Terms of Service

Please read carefully!
I know it’s a bit intimidating, but these were written with a lot of care, so that everything will go smoothly for both client and artist!
(´▽`ʃ♡ƪ)1. Overall
   ✧ By commissioning me, you agree to all items listed in my Terms of Service.
   ✧ I have the right to refuse any application.
   ✧ When the commission is delivered, you will receive:
         - A zipped folder containing the files ready for use with tracking software (VTube Studio, for instance);
         - Additional expression and animation files if included in the services chosen by the client.
         ⚠ Please note that art (.psd) and project files (.cmo3) will NOT be provided!   ✧ Credit must be given clearly in your social media, in an easy to see place (bio/about).
   ✧ The client cannot use any part of art or rig for any blockchain-related technology, including NFTs, cryptocurrency, and others.
   ✧ I do not allow repurposing, redistribution, or reselling of my work, unless you contact me and permission is given.
   ✧ I have the right to post any commissioned work to my social media for personal advertisement and portfolio, with credits to client and artist.
   ✧ If the client wishes, they can pay a privacy fee (20% over total price) and I won’t post any progress pics or videos until debut or 3 weeks after delivery (whichever comes first).2. Workflow
   ✧ Before applying, please read the Terms of Service and price tables. Please consider that there might be variations according to complexity.
   ✧ Apply using the form.
   ✧ I will inform you if your application has been selected (or rejected). If it is accepted, I will contact you to discuss further details, such as final price and deadlines.
   ✧ The client must inform me of their planned debut date before I start the commission. I will not change my deadline after the date has been agreed on and I start working on the commission.
   ✧ Before starting to work on the commission, the client must pay 25% of the final price.
   ✧ In case the client commissioned rig-only:
         - The art must be provided in a PSD file, already separated for live2d standards. If the art is not rig-ready, I will refuse the commission. I will not receive the 25% initial payment before the art is provided.
         - If there is any need for additional art (due to revisions or other reasons), I have the right to cancel the commission (without refunding the initial 25% payment) or postpone the deadline.
         ⚠ Please note that the quality of the final work depends on how well your art is separated! I will do my best to provide the best quality work I can within the limitations of the artwork provided by the client.   ✧ I allow a maximum number of free revisions as follows:
         > Art revisions (in case you purchased art+rig):
            - Up to 5 minor revisions
            - 1 major revision
         > Rig revisions:
            - Up to 5 minor revisions
            - 1 major revision
            ⚠ Please note that major revisions will NOT be free of charge if they contradict instructions given before I start working on the commission.   ✧ Further revisions will be charged according to complexity.
   ✧ I will only start working on the rig after the client has approved the art. Major art revisions will not be accepted after I start working on the rig.3. Payment
   ✧ Once the commission is done, the client will be shown the finished work and, if approved, must make the final payment (i.e., the remaining 75% of the total price) before any of the files are delivered.
   ✧ Billing is in USD and payments are made through PayPal invoice.
   ✧ For clients in Brazil, payment can also be made via Pix or bank transfer.
   ✧ As previously stated, the client pays 25% before I start the commission, and the remaining 75% before delivery of the final files.   ✧ Refunds will ONLY be given when:
         - I cannot meet the deadline (except when the client is at fault for not responding in due time).
         - The client wishes to cancel their purchase and I haven’t started working on the commission yet.   ✧ Refunds will NOT be given when:
         - The deadline cannot be met due to idleness on the client part (i.e. the client has not responded, causing delay).
         - The artist has not delivered additional resources necessary for rigging (in case the commission is rig-only and I’m rigging someone else’s art).
         - The final files have already been delivered.4. Delivery
   ✧ Files will be delivered through Google Drive, in a zipped folder containing everything needed to run the model in any software that is compatible with Live2d (VTube Studio or PrprLive are recommended). The project file (.cmo3) will NOT be included in the delivery.
   ✧ Additional expressions, animations, outfits, and other upgrades after delivery will be treated as a separate order and must go through the same process as the original commission.
   ✧ After the files are delivered, if the client has any number of free minor revisions left, they will have 1 week to request them.Aaaand that’s it!If you have any questions, feel free to contact me through discord (tooru#9798) or e-mail ([email protected]).
